NON-EXCLUSIVE LICENSE TO USE

OF COPYRIGHT

12 HOUSE CONCEPTS

1. INTRODUCTION

The digital products and complementary services sold by ION EREMCIUC ARCHITECTS SRL, with registered office in Jud. Cluj, Cluj-Napoca, Str. Taietura Turcului nr. 23, Floor 4+5, Apartment 15, no. of order in the Trade Register J12/315/2017, unique registration code RO32145867, represented by administrator Ion Eremciuc, e-mail address contact@12hc.ro, phone number +40 748 942 463, through the website https://www.12hc.ro/ ("Website") are the subject of copyright owned by ION EREMCIUC ARCHITECTS SRL and benefit from legal protection.

Please read this document carefully before purchasing, downloading, accessing any product sold on the Website.

By checking to accept this License, by accessing, using any purchased product you confirm that you agree to be bound by these terms of use.

In the situation where you are the representative of a legal entity, you confirm that you have the right to legally employ that legal entity, and both you as a representative and the legal entity you represent will be bound by these terms of use.

2. COPYRIGHT PROTECTION

Concepts/models of houses, architectural projects, any written materials/videos/images etc. are protected by copyright. provided as part of consulting services, renderings, presentation videos, descriptive texts, photographs, images, as well as any other works in the artistic, literary and scientific field, regardless of the mode and form of expression, as they are presented on Website and/or purchased by buyers of 12 HOUSE CONCEPTS products and services (“Buyers”) (hereinafter referred to as "Works").

By purchasing 12 HOUSE CONCEPTS products and services, as defined in the Terms and Conditions, ION EREMCIUC ARCHITECTS SRL does not transfer the copyright on the Works to the Buyers.

3. NON-EXCLUSIVE LICENSE

As a result of the purchase of 12 HOUSE CONCEPTS products and services, ION EREMCIUC ARCHITECTS SRL grants the Buyers a non-exclusive license to use, for downloading and access for personal purposes, non-transferable, for a fee, in any territory, in the limited manner provided for in art. 7, in these conditions (“License”).

All intellectual property rights remain the property of ION EREMCIUC ARCHITECTS SRL, the latter being fully free to exercise all patrimonial and moral copyright rights over the Works, including by granting the same type of license to any other person.

4. ENTRY INTO FORCE AND DURATION

This License enters into force on the date of delivery of the ordered product, after the conclusion of the contract for the sale of products/services between you and 12 HOUSE CONCEPTS, under the conditions described in Terms and conditions. 

The term of this License is indefinite.

5. REMUNERATION

12 HOUSE CONCEPTS grants you this License in exchange for payment of the price of the product as stated in your order in accordance with the Terms and Conditions.

6. TERRITORY

This License is granted for any territory.

7. PERMITTED USES

After purchasing the products/services, ION EREMCIUC ARCHITECTS SRL grants the Buyers a non-exclusive license to use the Works under the following conditions:

  • Buyers are allowed the following uses of the Works, as the case may be, provided that they comply with good customs, do not contravene the normal exploitation of the Works, do not harm the company ION EREMCIUC ARCHITECTS SRL and the author, Architect Ion Eremciuc, and the source is indicated - https://www.12hc.ro/, the name of the author Architect ION EREMCIUC and the name of the copyright holder ION EREMCIUC ARCHITECTS SRL, in a visible place:

  • the use of short information, for the purpose of analysis, commentary or criticism or as an example, to the extent that their use justifies the extent of the information;

  • the digital uses of short information in the online environment to the extent justified by the non-commercial purpose pursued, by the sole objective of didactic illustration, for the purpose of analysis, commentary or criticism or as an example, provided that such use does not pursue a commercial purpose ;

  • the construction of architectural works according to the projects created by ION EREMCIUC ARCHITECTS;

  • the architectural studies and projects exhibited in the appropriation of the architectural site, as well as the construction carried out after them, will bear, in a visible place, the name of the author Architect ION EREMCIUC and the copyright holder ION EREMCIUC ARCHITECTS SRL

  • Consumer buyers may use the Works solely for personal, non-commercial purposes.

  • Legal entity buyers may use the Works for their own use - for example, real estate developers will use the Works only for the purpose of building the real estate complex and for the purpose of marketing and promotional campaigns in this regard, and not for the commercial purpose of reselling the Works. The license in the case of legal entities is limited to the use in connection with their own activity, the promotion of their products and services, resale and any other operations not expressly granted herein being prohibited.

  • In any case and in any promotional material, the name of the ION EREMCIUC Architect, the copyright holder ION EREMCIUC ARCHITECTS SRL and the link to the Website will be mentionedhttps://www.12hc.ro/, in a visible place.

  • The right of use refers to the personal/proper use of the Buyers and not to the personal use of others.

  • The works consisting of house projects can be adapted, modified or transformed only for the purpose of using them for personal purposes, namely for the purpose of obtaining the building permit and building the construction according to the architectural project or for purposes related to one's own activity, marketing and campaigns promotion.

  • Through this document, ION EREMCIUC ARCHITECTS SRL non-exclusively grants the Buyer the right to create derivative works consisting of adaptations, modifications and transformations for the purpose specified above.

  • Adaptations, modifications, transformations can only be made by the Buyer or with the Buyer's authorization only for the stated purposes. Buyer will not make derivative works and will not grant any person the right to make derivative works for any purpose other than as provided in this License.

  • Any other uses, intended uses by a person other than the Buyer or for purposes other than those provided for in this User License, may only be carried out with the prior written consent of ION EREMCIUC ARCHITECTS SRL

  • For the avoidance of any doubt, the non-exclusive License of the right to transform the Works under the conditions provided has no effect on the other rights of ION EREMCIUC ARCHITECTS SRL

  • In any case, the Buyers will ensure the display of the name of Architect ION EREMCIUC, the name ION EREMCIUC ARCHITECTS SRL in a visible place and will not affect in any way the image, reputation and copyright of Architect ION EREMCIUC respectively of ION EREMCIUC ARCHITECTS SRL

  • ION EREMCIUC ARCHITECTS SRL is exempt from liability regarding any uses permitted to the Buyer, including but not limited to the project modified by the Buyer.

8. PROHIBITED USES

In the field of intellectual property, rights not expressly transferred remain the property of the owner. Therefore, the following uses represent an exemplary, not exhaustive, list of prohibited uses for the Buyer and third parties, without the prior express consent of ION EREMCIUC ARCHITECTS SRL:

  • Providing third parties with a link to the Website https://www.12hc.ro/or any other link that grants access to a purchased digital product, accessible only to purchasers of 12 HOUSE CONCEPTS products and services or the authorization of such operations.

  • Providing the Works for accessing, downloading, using in any way on the Internet.

  • Copying in any form and by any means, in whole or in part, the products/materials offered in connection with the provision of consulting services.

  • Modification in any way, by any techno-digital process of digital products, images and videos.

  • Selling, reselling, renting, making available, any type of transfer for a fee or free of charge, relicensing, sublicensing the purchased products/services.

  • Incorporation of 12 HOUSE CONCEPTS products into Buyers' intellectual property.

  • Using our products/services for the purpose or having the effect of violating the law or prejudicing our legitimate rights and interests in any way.

9. LIABILITY

Buyer will take all security measures so that the use and access to the purchased product is safe, according to the terms of this License, and no third party will undertake any act that contravenes this License.

The buyer will be liable for any violation of intellectual property rights and will grant compensation to ION EREMCIUC ARCHITECTS SRL and/or the author Arch. ION EREMCIUC for any damage, direct or indirect, suffered by them as a result of the actions/inactions of the Buyer or third parties , due to the fault of the Buyer, which have as their purpose or effect, directly or indirectly, the violation of intellectual property rights.

10. PARTIAL NULLITY

If any provision of this License is found to be illegal or unenforceable, such finding will not invalidate or render impossible the enforcement of the License. The remainder of the provisions of the License shall remain in full force and effect, and such provision shall be deemed modified to the extent necessary to make such provision or the remainder of the License enforceable. The rights and obligations of the parties shall be construed and enforced accordingly, preserving to the fullest extent permissible the intent of the parties set forth in the original License.

11. APPLICABLE LAW AND DISPUTE RESOLUTION

This License is governed by and construed in accordance with the laws of Romania.

Any complaint shall be addressed to 12HOUSECONCEPTS at the following email address: contact@12hc.ro, indicating the contact details of the complaining person and will include a detailed description that will allow us to analyze and resolve the complaint. You will receive a response to any complaint/address within a maximum of 30 (thirty) days, depending on the nature and complexity.

Disputes between 12 HOUSE CONCEPTS and Buyers will be settled amicably.

If the parties cannot resolve the dispute within 30 (thirty) days of its occurrence, the interested party may file an action with the competent Romanian court.
